THE SPORTS UNIVERSE — PARTICIPANT WAIVER, RELEASE OF LIABILITY AND ASSUMPTION OF RISK
This agreement covers every program and activity of The Sports Universe (Sports Universe LLC), its owners, staff, coaches, volunteers, contractors and affiliates ("Sports Universe"), including classes, pods, leagues (including the SUSHL street hockey league), mini camps and summer camps, birthday and Color War parties, private lessons and team training, open play, clinics, special events and off-site programs, at 355 Eisenhower Pkwy, Livingston, NJ and at any other location Sports Universe uses (for example Kushner Academy and O’Connor Park). It has no expiration date: it stays in effect for every current and future visit, program and activity until I revoke it in writing or replace it with a newer waiver.
1. Assumption of risk. I understand that sports and physical activities involve inherent risks, including running, jumping, throwing, catching, contact with other participants, balls, sticks, bats and equipment, falls on turf and hard surfaces, and weather conditions outdoors. These risks can cause injuries such as sprains, fractures, concussions, and in rare cases serious injury or death. I knowingly and voluntarily accept these risks on behalf of myself and each child listed.
2. Release and waiver. To the fullest extent allowed by law, I release, waive and discharge Sports Universe from any and all claims, demands and causes of action for injury, illness, death or property loss arising out of participation in or attendance at any Sports Universe activity, including claims based on ordinary negligence. This release does not apply to gross negligence or willful misconduct.
3. Indemnification. I agree to indemnify and hold harmless Sports Universe from any claim, cost or expense (including reasonable attorney fees) arising from my or my child’s participation, including claims brought by or on behalf of my child.
4. Medical authorization. I authorize Sports Universe staff to provide or obtain first aid and emergency medical treatment for each child listed if I cannot be reached, and I accept responsibility for the cost. I confirm each child is physically able to participate and I have disclosed any medical conditions, allergies or limitations below.
5. Rules and conduct. I agree that each participant will follow staff instructions, facility rules and safety equipment requirements (for example helmets with cages for hockey). Sports Universe may remove any participant whose behavior is unsafe.
6. Photo and video. I understand Sports Universe may take photos and video during activities. My photo choice is below.
7. Guardian authority and governing law. I am the parent or legal guardian of each minor listed and have the authority to sign for them. This agreement is governed by the laws of the State of New Jersey. If any part is found unenforceable, the rest remains in effect.
